If the SNP lose the case, the Tory government are proposing a bill that would set out the legal conditions to both issue a future referendum, and dictate the conditions for victory. The plan is clearly designed to make it harder to win such a referendum, but it still presents an opportunity to get a legally clear route to independence, assuming the Supreme Court conclude that one doesn't currently exist.
