3:19Now PlayingDavid Schoen, one of former President Donald Trump’s defense lawyers in his Senate impeachment trial, argued on Feb. 12 that Trump was denied due process in the swift second impeachment proceedings.
Schoen said that Trump’s team did not have the ability to review evidence against him or test its integrity. He also questioned why the Democratic House managers presented unseen video footage from the Jan. 6 attack on the U.S. Capitol.
“Shouldn’t the American people have seen this footage as soon as it was available? For what possible reason did the House managers withhold it from the American people and President Trump’s lawyers? For political gain?” Schoen asked.
However, the PBS NewsHour's Yamiche Alcindor reported that a source close to the House managers, who prosecuted the case in the Senate, dispute Schoen's claims, saying that the rules required that video be turned over to Trump's lawyers.
Schoen spoke as the former president’s defense team offered their case for why the Senate should acquit Trump on the charge of inciting an insurrection for his role in the Capitol attack. Trump was impeached by the House in January, while he was still in office.
