Both the State and the Defense have filed motions addressing a random survey the Defense is conducting of residents of Latah County who could potentially be summoned as jurors, to investigate the reach of press coverage in the case and whether the local jury pool can be fair and unbiased. The State says the survey violates the gag order and wants some input into what questions can be asked. The Defense says they have an accredited expert conducting the survey according to established objective standards and there is no gag order violation to discuss press stories that are already out in public.
