I've been a fan of Daniele Bolleli's work on the History on Fire podcast for years, so I was beyond thrilled to have him join me to tell the story of the Ponca removal to Indian Territory and the revolutionary legal challenge brought by Standing Bear. American Indian (that's the nomenclature in federal law, so it's what I use here) law is fascinating and often horrifying, and because of law's reliance on stare decisis, continues today to incorporate principles of second-class citizenship and dependency arising from the European settlement of the American west. This was a great conversation about what justice really means, through the tale of a man's struggle to gain access to the courts and recognition of his right to choose where and how to live.
