as posted by the channelKaren Read's defense team has argued that counts 1 and 3 should be dismissed based on affidavits from several jurors attesting that the jury unanimously agreed to acquit her on those counts. Because double jeopardy bars retrial of a person acquitted of a crime, they argue that she can only be retried on count 2, voluntary manslaughter. The Commonwealth contends that the law does not allow the court to consider the jurors' affidavits and the fact that any verdict was not formalized means it was preliminary and not binding.
