as posted by the channelThe first week of trial has been light on "science, facts, and data" and heavy on things Karen has said, inconsistencies in testimony, and memories that don't match the video record. At the start of week two, we'll be diving headfirst into "science, facts, and data" - but the jury won't get to hear it. After a half day of testimony today, the afternoon session is reserved for the Crash Daddies - Drs. Daniel Wolfe and Andrew Rentschler, the ARCCA crash reconstructionists who were hired by the FBI, disclosed through a Touhy request, and subpoenaed by the defense for trial 1.
Judge Cannone has been looking for reasons to exclude or limit the ARCCA witnesses as a defense sanction - hence the rather odd finding that the defense committed a discovery violation by not retaining text messages consistent with ABA record retention guidelines that don't apply in Massachusetts and are for the benefit of clients anyway. Hank Brennan has been accusing ARCCA of having secret communications with the defense team and subsequently lying about it. ARCCA has been compelled by the court to produce a large volume of information and to complete all new experiments by today. Whatever happens today, the outcome is probably going to determine whether Karen Read will be allowed to challenge the Commonwealth's claim to "science, facts, and data,"
