as posted by the channelIn late September 2024, a fire at the BioLab pool-chemical manufacturing facility in Conyers produced a large chemical plume that drifted across parts of metro Atlanta, triggering public safety actions and a prolonged cleanup.
Effects following the fire were felt across Rockdale County as evacuation and shelter-in-place orders were issued. Roughly 17,000 people near the facility had to be evacuated, and more than 70,000 others were ordered to shelter in place for several days.
The court is considering these questions:
Under Georgia law, may plaintiffs who have been exposed to toxic substances which may cause future disease, but who do not claim a present physical injury, obtain medical monitoring as a form of equitable relief in a tort action?
If the answer is yes, what is the legal standard for obtaining such a remedy?
