Boyle said he is skeptical that the White House can reach a deal on ICE reform before DHS funding runs out again and is concerned the government will face a long-term partial shutdown. The Department of Homeland Security has funding — and steady pay for all of its agencies — through 11:59 p.m. next Friday, so the week ahead should bring an intense new phase of negotiations.
Mica Soellner reports that the Trump administration says it will engage with Democratic leaders “in the coming days” — a time frame that doesn’t shed any light on what to expect over the weekend.
Democrats have a list of 10 demands that include banning face coverings, requiring judicial warrants for home searches, and mandating the use of body cameras.
Republicans will conduct hearings next week that will show their skepticism or support for what top leaders have to say about the performance of immigration agents.
Todd Lyons, the acting director of ICE; Rodney Scott, the Customs and Border Protection commissioner; and Joseph Edlow, the US Citizenship and Immigration Services director, are to appear at a House hearing Tuesday and a Senate hearing Thursday. In between, a House Appropriations subcommittee plans a Wednesday hearing on “potential DHS shutdown impacts.”
Separately, several US attorneys have warned the Fifth Circuit appeals court that a “flood” of litigation by migrants challenging their detention has created a “substantial drain on the resources” of their offices, in declarations filed with the court in December, Ben Penn, Celine Castronuovo, and Megan Crepeau report. The White House will engage with Democratic leaders “in the coming days” to discuss their demands for placing curbs on Immigration and Customs Enforcement, as they negotiate over funding the Homeland Security Department, according to a spokesperson.
Press Secretary Karoline Leavitt said on Thursday there will be “grave repercussions” for agencies operating under DHS if a funding agreement cannot be reached. Leavitt said a potential pause in operations could affect national security and result in missed paychecks for border patrol agents and the US Coast Guard.
Leavitt added that while the White House is willing to negotiate with Democrats, it won’t soften on its mission to deport undocumented individuals.
“The president is never going to cave on this administration’s core promise to deport illegal aliens,” Leavitt said at the briefing.
DHS is set to run out of funding by Feb. 13 unless Congress can reach a bipartisan solution on implementing changes to the agency. The department came under scrutiny by both parties after ICE agents shot a protester last month in Minneapolis.
The White House has been careful in its response to public pushback on ICE and its immigration control tactics, while trying not to weaken its policies on mass deportations.
Democrats, meanwhile, have called for extensive changes to ICE and the removal of DHS Secretary Kristi Noem from her post, which the administration has refused to consider.
Senate Minority Leader Chuck Schumer and House Minority Leader Hakeem Jeffries sent a letter to GOP leadership on Wednesday laying out a 10 demands on proposed changes at DHS.
The Democratic leaders requested a ban on face coverings for ICE agents. They also want to require the agency use judicial warrants for home searches, and mandate officers wear body cameras.
