But a New York appeals court last month sided with Mr Svenson, who started photographing neighbours surreptitiously in 2012.
An acclaimed artist, Mr Svenson embarked on the project after “inheriting” a powerful camera from a friend who used it for birdwatching.
Hiding in the shadows of his darkened lower Manhattan flat, Mr Svenson took a portfolio of pictures of those who lived around him."
