as posted by the channelWas Kyle Curtis properly served? Kyle's motion does not give any legal grounds to set aside judgement. None of the citations involved a case where the defendant received papers by certified mail to an address where someone of "appropriate age" signed for them except one where it was a 15 year old son which we determined to be of "suitable age" and service was upheld. He can rebut service if shows "excusable neglect", or he didn't receive papers. He never argues he didn't receive papers. He has no indication of complying with court order.

"9. Mr. Curtis has not responded to Mr. McRae’s latest filing, and he is not required to under the orders of the Chief Justice. But for those orders, the Court would issue Mr. McRae’s requested order that Mr. Curtis appear and show cause why he should not be held in civil contempt until he has fully complied with the Court’s Judgment or demonstrated adequate grounds that such Judgment must be set aside."
The judge has made it very clear to Kyle Curtis he is willing to use "incarceration" as a means to comply:
"10. "...if Mr. Curtis, in fact, has willfully violated and continues to violate the Court’s Judgment during the period in which the Court is unable to hold the required hearing before finding him in civil contempt, the Court will give appropriate consideration to imposing all permissible sanctions, and if necessary, requiring Mr. Curtis to be imprisoned until he fully complies with the Court’s orders. "
