as posted by the channelA court ruled that Sarah Palin was NOT defamed by the New York Times. Back in 2017, the New York Times authored an editorial linking Palin to a mass shooting and assassination attempt on Arizona Rep. Gabrielle Giffords. Palin alleged in court that she received death threats following the New York Times’ editorial linking her campaign rhetoric to that assassination attempt.
This was all over a 2017 article about a crazed Bernie Sanders supporter shooting GOP Rep. Steve Scalise. And the Times was playing what about ism and linked Palin’s rhetoric and nonprofit to the shooting of Gabby Giffords without evidence. The Times corrected the editorial the day after it ran stating that the Times had “incorrectly stated that a link existed between political rhetoric and the 2011 shooting.”
The Times didn’t argue in court that they DIDN’T smear her, but their lawyer argued that Palin had not met the standard of “actual malice” which means that Palin’s lawyers couldn’t prove that the Times knew they were lying about Palin with the intent to harm her. It doesn’t mean that the Times wasn’t wrong, it just means Palin’s lawyers couldn’t prove actual malice in court.
