Recent years have seen a spike in climate litigation and a plethora of media coverage looking at the views of litigants, activists, academics, civil society stakeholders, company executives and others.
And yet….
Little attention has been paid to the processes of judicial decision-making, to principles of interpretation and the meaning of the rule of law in the context of climate action.
We therefore bring to COP26 an important collection of five-minute video contributions from seven senior Justices from around the globe who look at the law in their role as senior members of the judiciary.
The justices explore the following key questions to shed light on the past, present and future of climate litigation:
How has judicial decision-making on climate change issues evolved in your jurisdiction over the last decade?
What are the most useful norms, legal principles or practices available to judges to ensure effective climate action by governments and businesses?
What particular challenges are faced by judges and courts in dealing with climate change issues, and how can these be overcome?
How can the global legal community ensure that climate considerations and obligations are fully integrated into all areas of legal practice?
How optimistic are you about the ability of the courts in your jurisdiction to adapt to the future challenges of climate change?
