For years, I’ve turned to lawyer and National Review columnist Andrew McCarthy for honest analysis of America’s legal and political battles. Long before the rest of the country was trying to make sense of indictments, immunity rulings, and the growing politicization of the Justice Department, Andy was already doing the work, calling balls and strikes in real time, with no allegiance except to the law as it is written.

So when he joined me for this week’s episode, I wanted to do more than simply recap the latest headlines. I wanted to trace the arc of American justice itself, and to understand how a prosecutor who once helped dismantle the Mafia now sees that same system bending under political pressure. Andy told me he believes the rise of lawfare may be the most consequential shift in modern public life.

This conversation couldn’t feel more timely. Last week, a federal judge dismissed the criminal cases brought by the Trump administration against former FBI director James Comey and New York attorney general Letitia James—cases Andy viewed as retaliatory. As we wait for the next episode in this tit-for-tat lawfare battle, Andy provides sobering analysis of what it all means for the future of the American justice system.
