Just before the hearing was set to begin, Attorney Alan Jackson announced he is dropping the case, according to TMZ. Court delayed arraignment until a public defender can take over.
His scheduled appearance comes 3 1/2 weeks after the beloved actor-director and his wife of 36 years were found dead with stab wounds in their home.
