Trial attorneys and former prosecutors Joshua Ritter and Randolph Rice break down the defense’s two most consequential arguments. Anthony’s lawyers say prosecutors changed their position on a “gentleman’s agreement” governing damaging character evidence just as Anthony was preparing to testify, leaving him only 10 minutes to confer with his attorneys before deciding not to take the stand.
The defense also argues that restrictions on courtroom access violated Anthony’s Sixth Amendment right to a public trial. Could that alleged violation require an automatic new trial, or were the restrictions justified in a case surrounded by threats, misinformation and intense public attention?
Anthony was convicted of murdering 17-year-old Austin Metcalf at a Texas high school track meet after jurors rejected his claim of self-defense. Retired Judge Michael Chitty is considering the motion after Judge John Roach was removed from the post-trial proceedings.
