This matter comes properly before the Court for a trial by Jury.

Deputy County Attorney, Mike Jette, Esq., and Kimberly Hunley, Esq. is present and representing the interests of the State; Detective, Jorge Ainza; Defense counsel, Brenna Larkin, Esq., and Kathy Lowthorp, Esq. on behalf of the defendant and the defendant, whom are, present in the courtroom. Let the record reflect that the jury panel resumed deliberation at 8:30 a.m. the jury continues with deliberations.

On the record at 8:38 a.m. the Court advises counsel that there is a question from the jury panel; and was asked and answered by the parties.

At 10:17 a.m. the Court advises counsel that there is a question from the jury panel; and was asked and answered by the parties.

Upon inquiring by the jury, the State and defense counsel collaborate on preparing an answer for the jury.

At 1:57 p.m. back on the record the Court addresses a notice from the jury panel submitted to the bailiff at 1:45 p.m. indicating the tally of where they are at this time.

Let the record reflect that the Court has not read the note submitted by the jury.

Upon agreement of the parties the Court responds as follows:

The Court makes a record that the jury has deliberated for a few hours at this point.

Back on the record with another note 2:11 p.m.

Said note indicates that the jury is looking for guidance upon an impasse.

The parties discuss with what instruction to respond to the jury.

At 2:16 p.m. the Court steps off the bench to confer as to whether they will object to an impasse instruction.

The Court comes back on the record at 2:25 p.m. and informs counsel his ruling as to the impasse instruction.

The jury is now present in the courtroom at 2:29 p.m. the Court address the jury panel.

At 2:32 p.m. the Court excuses the jury panel to continue deliberations.

At 3:05 p.m. the Court comes on the record with another question from the jury, question was

answered at 3:09 p.m.

At 3:57 p.m. back on the record the Court addresses a notice from the jury panel submitted to the bailiff at 1:45 p.m. indicating that the jurors would like to be dismissed and return on Monday at 8:30 a.m. No objection by the parties.

The State address the Court regarding a request made to the Clerk of the Court for a recording of the trial proceedings.

The Court directs the State to file a motion in writing.

The Court excuses the jury and are directed to be back on Monday, April 22, 2024 at 8:30 a.m.

There being no further issues on this matter this hearing is adjourned.
