Alex Murdaugh’s lead attorney has formally withdrawn his claim that Murdaugh passed a polygraph examination “with flying colors.”
Dick Harpootlian told Judge Debra McCaslin that he had mistakenly conflated several facts when discussing polygraph testing during a retrial hearing. Prosecutors say Murdaugh was never given a SLED polygraph about the killings of Maggie and Paul Murdaugh and was never examined by the same polygraphers who tested Curtis “Eddie” Smith.
According to prosecutors, an FBI polygraph administered after Murdaugh’s first murder trial concerned his financial crimes—not the murders—and the results indicated that he failed and may have attempted countermeasures.
Harpootlian describes his original statement as a mistake. Prosecutors allege it was an intentional effort to influence the court and public opinion.
The judge has already barred polygraph evidence from Murdaugh’s retrial, but this confrontation raises new questions about credibility between two legal teams preparing for another nationally watched trial.
