“Most people consider it totally unconstitutional. Also we had a ceasefire. That gives you additional time,” he said. “But no other country’s done it. We’re in the midst of a big victory. This is a victory like we haven’t had since Venezuela, okay, to be honest with you.”
The War Powers Resolution, enacted in 1973 during the Vietnam War over President Richard Nixon’s veto, requires the president to notify Congress within 48 hours of military action and seek approval to continue hostilities beyond 60 days, with a limited extension for withdrawal.
Presidents of both parties have raised constitutional concerns about the law, arguing it infringes on the president’s Article II powers. Courts have never definitively ruled on its constitutionality.
