0:52Now PlayingAn athletic club in California is being sued by parents whose toddler was injured in the club’s daycare facility, with video appearing to show a worker tossing the boy over her head and failing to catch him.
CCTV released by Rosen Saba, LLP, the law firm representing the toddler’s parents, shows the moment the 23-month-old child at the Bay Club in El Segundo is dropped several feet onto an uncarpeted floor on March 17, 2025.
The footage shows the worker swinging the toddler through her legs multiple times before swinging him up over her head. The worker then fails to catch him and topples onto the boy.
According to the lawsuit filed by Rosen Saba, the child suffered a traumatic brain injury and hearing loss after the employee failed to catch him. The family is suing the club for negligence, battery, fraud, and emotional distress.
The lawsuit claims the club misrepresented the circumstances of the incident when notifying the family of their child’s fall.
“The deception by the Bay Club of hiding this horrific incident from the parents is inexcusable. The day care facility should have the highest amount of care for the children, and if a child gets sick or injured, they should notify the parents with transparency and urgency,” Ryan Saba of Rosen Saba, LLP, told Storyful.
The Bay Club told local news outlet KABC-TV, they could not comment on ongoing litigation and said safety is their highest priority.
