đš THE CLOCK IS TICKING đš
Twenty days until Aaron Spencerâthe Arkansas father charged with killing his daughter's accused predatorâfaces a Lonoke County jury. And the court just dropped a stack of rulings that could make or break this case.
Join Defense Diaries LIVE as we break down EVERY new filing:
âïž DEFENSE WINS:
â Opinion and reputation evidence about Michael Fosler's violent character ALLOWED under Rule 404(a)(2)âthe jury will hear what kind of man Fosler really was
â Crime scene expert Clint Norris CLEARED to testify
â ïž THE STATE GETS ITS VIGILANTE EVIDENCE:
The court ruled Spencer's prior statements are coming in. The prosecution wants the jury to believe this was premeditated vigilante justiceânot a father protecting his daughter from imminent danger. We'll break down how the defense can counter this narrative at trial.
â THE SETBACKS:
đ« Expert witness Carrie Landau EXCLUDEDâno testimony on child sexual abuse grooming dynamics
đ« Dr. J. Consulting testimony DENIED
đ« All witnesses must appear IN-PERSONâno Zoom testimony at trial
đ« Cell-site evidence ADMITTED (but limited to general location, no pinpoint accuracy)
đ„ THE FIGHT CONTINUES:
The defense just filed TWO motions to reconsider:
Expanding Fosler's reputation evidence BEYOND Lonoke Countyâthis predator lived in Indiana, Pulaski County, and elsewhere. A person's violent reputation doesn't disappear just because they move. Why should the jury only hear about his character in one county?
Reconsidering the Carrie Landau exclusionâa 21-year FBI veteran with over 1,000 child exploitation interviews. Her testimony on grooming could explain WHY Spencer's daughter appeared to leave "willingly" with her abuser that nightâand why she was STILL in imminent danger despite that appearance. The State is already suggesting the daughter "snuck out" and wasn't actually kidnapped. This expert could destroy that argument.
THE STAKES:
This case is about to test Arkansas law on defense of another. Did Aaron Spencer reasonably believe his 14-year-old daughter was in imminent danger when he found her with the man charged with 43 felony counts of sexually abusing herâa man who was OUT ON BOND, violating a NO-CONTACT order, at 1:30 in the morning?
