▶ THE CASE On January 24, 2023, first responders were called to a home on Summer Street in Duxbury, Massachusetts. Inside were three children — Cora, 5, Dawson, 3, and 8-month-old Callan. Their mother, a labor and delivery nurse, had gone out a second-story window. She survived, paralyzed from the waist down.
Lindsay Clancy has pleaded not guilty by reason of insanity.
The defense says what happened in that house was the end point of severe postpartum mental illness and a rapidly escalating cocktail of psychiatric medications — what Kevin Reddington has called "a toxic soup" — and that Clancy was acting on a voice in her head.
The Commonwealth says it was a deliberate, premeditated plan: that she engineered the window of time she needed alone with her children, and knew exactly what she was doing.
▶ WHAT ACTUALLY DECIDES THIS: In Massachusetts the McHoul standard is the legal test used in to determine criminal responsibility and the insanity defense. The question is whether, because of mental disease or defect, Clancy lacked substantial capacity either to appreciate the wrongfulness of her conduct or to conform her conduct to the law. The Commonwealth has to prove she was criminally responsible beyond a reasonable doubt. That is the fight. Everything else is scaffolding.
