Prior to sentencing, Jose Baez submitted documents arguing that if the defendant did shoot anyone, it was due to alcoholism and childhood trauma; but the judge dismissed the mental illness argument, noting that just because alcoholism was involved in the crime, it doesn't mean he's an alcoholic. The defense was seen as contradictory, claiming both alcoholism and being an exemplary role model for the defendant's son, leading the D.A. to accuse the defense of avoiding responsibility for the crime.
