"I knew it must have been her because that wasn’t an accident," Marquez said.
IT WAS FEBRUARY 2016. MARQUEZ WAS VISITING HER HUSBAND IN MEXICO WHEN POLICE SAY OCAMPO-GARCIA SEVERELY BEAT THE YOUNG CHILD WITH A PLASTIC TOY.
OCAMPO-GARCIA WAS IN A RELATIONSHIP WITH THE BOYS FATHER.
EMTS RUSHED TO THE HOUSE…WHERE CARLOS WAS UNRESPONSIVE, VOMITING AND BLEEDING FROM THE NOSE AND MOUTH.
“He hadn’t fallen and done that damage. We knew from the start that this wasn’t an accident, somebody did this to him and she was the only person that was with him," Marquez said. “It was a full blown attack on him."
DOCTORS DISCOVERED SEVERE INTERNAL BRAIN BLEEDING AND HAD TO REMOVE A PORTION OF CARLOS’ SKULL TO RELIEVE PRESSURE.
THE PROGNOSIS WAS NOT GOOD.
“A vein detached from his brain and it was bleeding so much that parts of his brain were not functioning,” Marquez said. "He just looked like he wasn’t going to be the same. I knew that. It was so hard seeing him struggle like that," Marquez said.
CARLOS WAS PUT IN A MEDICALLY INDUCED COMA AND THE EFFECTS OF THE BEATING WERE LIFE-ALTERING.
“He couldn’t move his whole right side. He couldn’t talk anymore he couldn’t eat. It affected his vocal cords and his tongue,” Marquez said. “He had a hemorrhage on the cornea."
OCAMPO-GARCIA ADMITTED TO GRABBING THE BOYS HAIR AND THROWING HIM TO THE GROUND…AND STRIKING HIM REPEATEDLY IN THE HEAD. SHE WAS CHARGED WITH was charged with felony aggravated battery and felony use of a deadly weapon.
AND ENDED UP ENTERING A PLEA AGREEMENT AND PLEADING GUILTY TO a felony injury to a child charge with an enhancement for inflicting great bodily injury on the child
…BUT FOR CARLOS’S MOTHER, THAT WASN’T ENOUGH.
“All wanted was revenge at first, I just wanted her to pay, and then I realized... this hate toward her is keeping me from being with my son and concentrating on him. From that day on I know God’s going to take care of it," Marquez said.
ON SEPT. 11, OCAMPO-GARCIA WAS SENTENCED TO 3 to15 years FOR HER CRIME AND MARQUEZ WAS SADDENED THAT THE WOMAN WHO BEAT HER CHILD SHOWED NO REMORSE.
“At the court she didn’t seem like she repented or anything, she just seemed like normal. If that would have been me going to prison for three or 15 years I would have been crying my eyes out,”
TO THIS DAY…SHE HAS NEVER APOLOGIZED TO THE FAMILY ACCORDING TO MARQUEZ…BUT THEY ARE TRYING TO MOVE FORWARD.
CARLOS IS OUT OF THE HOSPITAL AND HAS LEARNED HOW TO WALK AND TALK AGAIN.
“The main thing is his hand, he still can’t use it. He needs help with everything. Tying his shoes, dressing, the restroom, playing, carrying things, eating, normal things that other kids can do with both hands he can’t. That’s the main thing for me is getting his hand to work,” Marquez said.
HE STILL HAS TO UNDERGO THERAPY AND THEY ARE TAKING IT DAY BY DAY…HOPING FOR THE BEST AND LOOKING FORWARD TO THE FUTURE.
“It’s been such long time since this happened that somehow I had it in my head that she was going to get away with it," Marquez said. “I was so relieved when I was wrong.”
