4:15Now PlayingSidney Powell is offering up the absolute dumbest possible rationale for why she shouldn't be disbarred. In a court filing this week, Powell and her lawyers argued that she shouldn't be disbarred for filing lawsuits based on conspiracy theories because people believe in those theories, and also, what if they might be true? That argument probably isn't going to get them anywhere, but as Farron Cousins points out, it is fun to watch them grasp at straws when they know they have no defense.

Sidney Powell and her legal team have filed a legal brief this week, trying to make sure that SI herself does not get disbarred for all of the frivolous election challenged lawsuits that she has filed. And in the filing this week, they made what might be the dumbest legal argument. I think I've ever seen. Let's read it prior in subsequent lawsuits have pointed to very similar problems and dozens of laws have been enacted by state legislatures in response to concerns similar to those raised in the complaint, millions of Americans believe the central contention of the complaint to be true. And perhaps they are.
Now, this is of course talking about lawsuits, alleging a bunch of election fraud. So let me just distill what they said there. They're trying to make the argument that, Hey, because these Republican controlled states are putting all knew these, uh, voter protections in place, trying to make sure there's no voter fraud and because everybody believes it way and maybe it's true. So therefore the court has to indulge us and you cannot punish Sidney Powell because maybe it's true. If you have filed a lawsuit alleging that a thing happened, you can't go to court and then say, maybe it's true. They literally say, perhaps they are when referring to the truth about the claims in the lawsuit, she filed this. I mean, God, again, I say this all the time, but I work every day with some of the best lawyers in this country. You think any one of them has ever filed a lawsuit and then gone to court and be like, judge, maybe this is true.
I don't know. Maybe. I mean, people believe it. So why not? Right? Jerry is maybe, oh my God. Oh my God. Like, I don't think we should just be talking about disbarring Sidney Powell at this point. I think maybe her legal team, if this is the best you've got, if you legitimately thought this was a proper legal argument to file in court, maybe we need to talk about disbarring you two or, or maybe we should make it to where you have to take the bar exam, you know, every five, 10 years, you know, just to, just to make sure your chops are still there. This is ridiculous. And it shows that they don't have a leg to stand on, like you can't to court and be like, Hey, people believe what I'm telling you anyway. So maybe it's a thing I don't, I don't know. No, it's up to you to prove it's a thing you can't just rely on. Like here's a poll that says that, uh, what I'm alleging might be true. So therefore we rest our case. Oh my God, this is so hilariously incompetent that it just makes me wonder how Sidney Powell and her legal team even passed the bar in the first place. It's not an easy exam.
However, again, they they're gonna, they're gonna lose this. They're going to lose it. Just like I kind of am right now, because this is so insane that they actually filed this in court saying that maybe your claims are true. Doesn't prove your case at all. It just proves what the court is trying to tell you. You did, which is you filed a knowingly frivolous lawsuit and we're gonna punish you for it.
