Donald Trump's legal team filed a motion this week, begging a judge to grant the former President "absolute presidential immunity" in any civil lawsuits filed against him related to January 6th. The legal team claims that Trump's appearance at the Stop the Steal rally was a presidential action related to a matter of public concern, and therefore they say he can't be sued. The argument is ridiculous, but it may actually work, as Farron Cousins explains.

Donald Trump's lawyers tried to argue in court this week via a motion that they have filed that the former president is somehow immune from any and all civil lawsuits related to January 6th, because as they claim his appearance at that stop, the steel rally that preceded the capital riot of course, was part of his official presidential duties and therefore covered under that. Oh, so coveted, absolute presidential immunity. Here's what they said in their filing president. Trump is shielded by absolute presidential immunity because his statements were on matters of public concern, no amount of hyperbole about the violence of January 6th, 2021 provides a basis for this court to carve out an exception to the constitutional separation of powers.

They then went on to say that if you want to hold a president accountable for what they do, the only way to do that is via impeachment. And of course, as we all know, they tried to impeach him and failed. So they added this a democratic controlled house of representatives already brought impeachment charges against president Trump for allegedly inciting and insurrection on January 6th, 2021, their effort failed. And president Trump was acquitted. These further lawsuits, aren't attempt to thwart that acquittal. And it is just this type of harassment that presidential immunity is meant to foreclose. Um, that's the worst legal argument I've ever read. And I've read a lot of legal arguments, uh, this past year from some of the dumbest people Donald Trump has ever hired to represent him just because you are acquitted in a criminal matter does not mean you cannot be sued in this civil matter matter.

Excuse me, related to the same event, J J just ask OJ Simpson, how well that went for him. Um, so for the, the lawyers to even argue that shows that they don't know what they're talking about. I mean, that's basic like law 1 0 1, you know, jurisprudence 1 0 1. If you don't know that you shouldn't be practicing law and they put it in the motion that they filed with the court, these are Mors folks. Donald Trump has hired morons to represent him in court. And honestly, I'm grateful for it, right? You know, not that bad as for the absolute presidential immunity. That is again, that's a gray area. I'll give him that much, but matters of public concern know because you included that phrase. He was speaking on matters of public concern. That's what might get you in trouble, cuz here's the thing, the matter of public concern was

A lie, right? The public concern was, oh, the election was stolen, but it wasn't stolen. So using that same logic, Donald Trump could get up there on any stage in the country and promote a lie. As president saying, listen, blue-eyed people are all actually vampires and you need to drive a stake through their heart. You know, cuz that's how you get rid of vampires, go fight like hell. And then if a bunch of people started killing blue-eyed people in this country, they couldn't argue well, it was a matter of public concern. People were talking about vampires. We had to do something that, that doesn't justify his statements at the time when the whole thing was based on something that's that's not real to begin with. Donald Trump's claims of voter fraud are as real as vampires. So a good prosecutor of course, a good lawyer because this isn't a prosecution, this is a, a trial matter. So a good trial lawyer would be able to pick that apart. And of course they would be given the opportunity to do so seeing how the defense has filed this idiotic motion. But uh, again, these are morons. These are absolute morons that Donald Trump has representing him. And honestly that may be one of the best things that the, uh, you know, trial lawyers have going for them at this point is the fact that his lawyers are so dumb that they got basic facts about the law, wrong in the motion that they filed this week.
