Former Trump Lawyer Is Confident He's Getting Indicted

One of Donald Trump's former lawyers says that he is confident his former client is going to be hit with criminal referrals from the January 6th Committee. The lawyer, Ty Cobb, isn't exactly showing a lot of confidence in his former client, and that is very telling. But the Committee seems to be unsure of whether or not to go through with these referrals, even with a mountain of evidence behind them. Farron Cousins explains the hesitancy.

A former lawyer for Donald Trump, and no, it's not Michael Cohen, but a former lawyer for Donald Trump told CNN this week that he is confident that his former client is gonna be hit with a criminal referral from the United States Department of Justice. That lawyer, of course, is Ty Cobb. He appeared on CNN where host Aaron Burnett asked him, do you have any doubt that the committee will have a criminal referral for Trump himself, referring to the January 6th committee? Of course, Ty Cobb responded by saying, I do not. I, I think they started out with that as a goal. And I think they certainly have put forth evidence, which would justify even in the absence of cross-examination, which I think is an unfortunate product of the committee's constitution. But even without cross-examination, clearly the evidence that they have put forward justifies them to make a criminal referral. So this lawyer that has seen the same evidence that we have, that the committee has put forth publicly, obviously they have a lot more stuff we haven't even seen, but based on what they've put forward publicly, this guy who once defended Donald Trump says, oh yeah, they, they definitely have enough to make that referral.

But he continues. Here's where the caveat comes in. Their referral is largely symbolic. Of course the Justice Department is not required to do anything in response to it, but yes, I'm sure they will for the former president. So I'm not sure if he's saying they will, in regards to the committee will send the referral or the DOJ will take action on it. Um, but he's right. The DOJ doesn't have to do anything with it. Those criminal referrals are just suggestions, basically. They, they, they mean nothing to put it bluntly. Um, cuz even if they do move forward with the criminal referral, they still have to do the case. Right. They've gotta go back and kind of recheck all the legwork, do additional work of their own additional investigation. And right now there's actually a lot of speculation, including a little bit of contention within the January 6th committee itself as to whether or not they're going to issue referrals for Trump himself.

It's been reported that some members of the committee, and they formed a little subcommittee to determine the criminal referrals. But some members are saying like, we don't need to send referrals for Trump because the DOJ is already working on that. Like, this is a, a bit of a redundancy. We don't have to do it because they're already working on it. And if they're gonna do it, they're not gonna do it based on our stuff. They're gonna do it based on their stuff. That's fair enough. Right? I mean, it, it's fair. I don't agree with it, but they're not wrong also. Right? It's one of those weird catch 22 things, like we could do it, but

We know they're gonna do whatever they're gonna do based on what they've got. I still say they should do it because the public is paying attention. The DOJ at the end of their investigation may come out and say, listen, we just don't have it to, to prosecute Donald Trump. We, we can't indict him. We don't have enough there. But if the committee sends them a criminal referral, which of course would go public, everybody would be talking about it. Left media, right media, everybody would be talking about it. That'd make it a little bit harder for the DOJ to try to chicken out of this. Right? It would put more pressure on them to take action against him. So even though the criminal referral would not be legally binding for the doj, it's good to put it out there in the ether. Let the public know we found stuff we think we could get him and put even more pressure on that DOJ to do something about it. That's what I think the committee should do. That's what I hope the committee does and even Donald Trump's former lawyer seems to think it's headed in that direction.
