DAY SEVEN Sentencing Phase of Sean Finnegan Trial, Aggravating and Mitigating Factors

56 year old Sean Finnegan's trial started with jury selected on August 12th, 2024 and is a death penalty trial in Tennessee, scheduled to last for 1-2 weeks. Opening Statements are anticipated on Tuesday, August 13th, 2024. Sean is accused of horrific acts against 36-year-old Jennifer Gail Paxton, whose body was discovered in August 2020 (it is believed that she died in December 2019). Codefendant Rebecca Dishman pleaded guilty in September 2023 and testified against her former partner. She also pleaded guilty to two s/a of a child charges and will serve a sentence of life in prison plus 50 years.

Under Tennessee rules, Sean Finnegan will face trial first to determine if he's guilty of first-degree murder. If the jury convicts, the same panel will then shift to a mini-trial, punishment phase, during which the state will put on evidence about the horrific nature of the crime and why it merits a death sentence. The defense will also get a chance to put on evidence to try to sway jurors to spare Finnegan's life.
