On May 21st, Tennessee Congressman Steve Cohen, who represents the Memphis area and has since been redistricted out of his seat, filed six articles of impeachment against Supreme Court Chief Justice John Roberts for high crimes and misdemeanors, violations of his constitutional obligations, and breaches of his oath of office. Hawk reads through Cohen's press release and all six articles in full.
The articles cover the court's partisan interference in elections through asymmetrical application of redistricting rules, the gutting of the Voting Rights Act and its impact on 26 million Black Americans in the South, the Citizens United decision and its entrenchment of wealthy donor influence, the presidential immunity ruling that placed Donald Trump above criminal accountability, the court's use of the shadow docket to issue sweeping decisions without oral argument or full briefing, and Chief Justice Roberts' failure to recuse himself from cases involving law firms that paid his wife Jane Sullivan Roberts millions of dollars in recruiting fees.
Hawk also addresses the court's shadow docket ruling on the Kavanaugh Stops case in Los Angeles, which carved out exceptions to the Fourth and Fourteenth Amendments and allowed ICE and law enforcement to stop and detain Hispanic and Latino Americans based on language, appearance, and association. Though the impeachment articles have no realistic chance of passing, Hawk supports their filing as a permanent part of the congressional record and a formal indictment of Roberts' tenure.
