The Supreme Court issued a 6 to 3 ruling on June 25th stripping Temporary Protected Status from approximately 1.3 million legal immigrants, most of them Haitian and Syrian. Hawk reads through the majority opinion written by Samuel Alito and Elena Kagan's dissent, and plays clips of Donald Trump and JD Vance making racist statements about Haitian immigrants during the 2024 campaign, including Trump's Springfield, Ohio claims that JD Vance later admitted were fabricated.
Hawk explains what Temporary Protected Status is, how it is granted to immigrants from countries experiencing civil war or natural disaster, and how those who hold it are vetted by the Department of Homeland Security every 18 months, making them among the most thoroughly vetted immigrants in the United States. Many of the Haitian immigrants affected have been here legally for ten to fifteen years, own homes, hold jobs, and have raised children who grew up entirely in this country.
The Haitian plaintiffs argued that Trump's decision to terminate their TPS designation was motivated by racial animus and cited his own statements as evidence. The district court agreed, finding the record strongly suggested racial motivation. Alito's majority opinion dismissed those statements as non-racial despite declining to quote them directly in the opinion. Kagan's dissent quoted them in full, including Trump's statements about Haitians eating pets, carrying AIDS, poisoning the blood of the country, and why the US should prefer immigrants from Norway or Sweden instead. Hawk also covers Amy Coney Barrett's role in the majority despite having two adopted children from Haiti, and the procedural steps the DHS Secretary is required by statute to follow before terminating TPS, which this court said are unreviewable.
