Roughly 400 masked members of Patriot Front marched through Washington DC on the 4th of July carrying flags, including some Confederate flags, prompting many people online to ask why they were allowed to march at all.

Hawk, a former trial attorney, offers an unpopular but legally grounded answer rooted in the First Amendment. The 1970s Skokie, Illinois case is the key precedent. A group of neo Nazis chose Skokie specifically because it was home to the largest population of Holocaust survivors in the country, and when the town denied them a permit, the ACLU, led by a Jewish attorney, fought for their right to march on First Amendment grounds and won.

Governments can impose time, place, and manner restrictions, but they cannot deny a permit based solely on the content of the message. Patriot Front did not incite, threaten, or engage in violence. They marched, they chanted, and they left.

Free speech and freedom of expression either apply to everybody or they apply to nobody. As distasteful as the group and its message are, that is the reality of the First Amendment, and denying speech based on its content is the most anti First Amendment position there is.
