After an hour-long hearing, the Justice Department agreed to withdraw the subpoenas it issued last Friday against several New York Times reporters who had covered the Qatari jet story. Hawk walks through Lisa Rubin's analysis of why the department lost: before subpoenaing a journalist, the government is expected to exhaust every other avenue first, and here it was reportedly the first step taken.
His larger point is about how those subpoenas were served. Rather than going through the paper's legal department, FBI agents delivered them to reporters at home on a Friday evening, during dinners and family movie nights. Hawk reads that as intimidation aimed less at these particular journalists than at smaller outlets without the Times' resources to fight back. The subpoenas came out of the Southern District of New York under Jay Clayton, now nominated to lead national intelligence.
