The federal case against David Hearn, a former Olympic canoeist charged with felony destruction of property over the Lincoln Memorial Reflecting Pool, is coming apart. Hawk, a trial attorney, reads from NBC News and RawStory reporting and walks through the motion Hearn's lawyers filed. The key development: the government's sole grand jury witness on damages testified that the pool was already damaged before Hearn touched it, that the same repairs would have been needed regardless, and that no loss could be attributed to him.
That matters because felony malicious destruction of property requires at least a thousand dollars in loss caused by the defendant. If the damage predated him, Hawk explains, the essential loss element collapses. Hearn's attorneys are asking for the grand jury transcripts and instructions, arguing that irregularities in the government's presentation suggest the grand jury may have been misled. Former federal prosecutor Glenn Kirschner compared it to other cases dismissed for prosecutorial misconduct.
Hawk lays out the backdrop: the administration blamed a 350-foot gash that was never found when the pool was drained, an algae bloom that followed the renovation, and the judge's own warning about altering the physical evidence at the center of the case. He expects the charges may be dropped rather than the transcripts released.
