Hawk revisits the Lincoln Memorial Reflecting Pool case now that the felony vandalism charges against David Hearn have been dropped. He plays back the press conference the DC US Attorney, Jeanine Pirro, gave about a month ago, when she stated the government could prove its case beyond a reasonable doubt, and sets it against the 20-page dismissal motion filed this week that concedes the evidence is not there.
The contrast is the whole story. Trump had repeatedly claimed he possessed photos and video of a 350-foot gash being cut into the pool, and Interior Secretary Doug Burgum echoed that proof existed. Yet the dismissal filing attributes the damage to a defective installation that began failing almost immediately, and Hawk argues no criminal conduct occurred at all. He walks through why a prosecutor should never hold a national press conference without personally reviewing the evidence first.
