CNN senior legal analyst Elie Honig, a former federal prosecutor, took apart Joe Borelli's account of why the Letitia James indictment collapsed. Borelli called it a technicality. Honig's answer is that Pam Bondi's appointment of Lindsey Halligan was unlawful, which made the indictment she brought unlawful, and that two further attempts failed to produce anything from a grand jury.
Hawk adds the comparison Honig gestured at. The civil case against Trump, his sons, and the Trump Organization turned on proven intent to defraud lenders over a decade. The half billion dollar judgment was later thrown out, but the fraud finding stands. Signing what a mortgage broker puts in front of you is not that.
There is also the setting. This ran alongside a Long Island rally where Todd Blanche spoke and endorsed a candidate for governor. A sitting Attorney General appearing at a partisan rally and endorsing from the stage is a departure from how the Justice Department is meant to operate, and it is getting less attention than it should.
Bill Pulte's role in surfacing the mortgage records is worth understanding too.
