A short follow up to yesterday's long video on the Supreme Court and racial profiling, prompted by another clip that surfaced overnight.
At a gas station in Florida, agents approached a man, handcuffed him, and arrested him. They did not know his name. He was not the subject of any investigation. What they had was how he looked.
Yesterday's clip showed agents in the back of a truck picking people out of traffic by appearance, using a slur that made the criteria explicit. Today's is the same thing without the commentary.
The legal background is what makes this possible. In a one paragraph shadow docket order last September, with no argument and no written opinion, the Court permitted stops based on apparent ethnicity, language, occupation, and location. Hawk's read is that the TPS ruling extends the same exposure to Black Americans, which by his count reaches 112 million people.
The long version, including Kavanaugh's concurrence and Sotomayor's dissent, is on the channel from yesterday.
