Hawk opens with something every trial lawyer learns to do: think in worst case scenarios. Part of preparing for a trial is imagining everything that could possibly go wrong so you are ready for it, and after enough years the habit never really switches off. That mindset is where this video lives, a hypothetical he dreamed up rather than anything he claims actually happened.
The thought experiment is this. A single juror holds enormous power, because one person refusing to agree with the other eleven can force a mistrial all by themselves. So what happens, Hawk wonders, when prediction market apps let people place real money bets on the outcome of a trial? What if, somewhere down the line, a juror bets that a case will end in a mistrial and then quietly causes that exact result from inside the deliberation room?
Hawk walks through why this scenario is so troubling, including the mechanics that make it nearly impossible to unwind. Once a judge declares a mistrial the case is closed, so even if someone discovered months later that a juror had wagered on the outcome, the finished trial cannot simply be reopened. He is emphatic that he has no evidence anything like this occurred in any real case, and is simply following the worst case scenario wherever his imagination takes it.
