However, Hawk felt Necheles' cross-examination of Daniels was largely ineffective, as it focused too much on slut-shaming and minute details irrelevant to the charges against Trump.
Hawk highlights that the key defense being presented is that Michael Cohen acted alone in paying Daniels, without Trump's knowledge or direction. However, testimony from Trump Organization employees Jeff McConney and Deborah Tarasoff undercut this defense by detailing how the reimbursement payments to Cohen were improperly categorized and recorded on Trump's instructions. Hawk believes their testimony provided most of the evidence needed to convict Trump.
He covers the defense team's unsuccessful motions for a mistrial and to modify the gag order to allow Trump to publicly respond to Daniels' testimony. The judge denied these, stating the defense opened the door to Daniels' testimony by denying any sexual encounter in their opening statement. The judge also criticized the defense for not objecting to prejudicial testimony at the time, missing their opportunity.
