FBI Director Kash Patel has filed a defamation lawsuit against The Atlantic following a report by journalist Sarah Fitzpatrick alleging episodes of excessive drinking and unexplained absences that senior sources described as a national security threat. The article drew on more than two dozen anonymous sources from inside the FBI, the White House, the executive branch, and the DOJ.
Hawk walks through the legal mechanics of what Patel actually needs to prove, including the heightened "actual malice" standard established in New York Times v. Sullivan, which requires a public figure to show that a publisher knowingly printed false information or acted with reckless disregard for the truth. That is an exceptionally high legal bar.
Patel's core argument rests on the claim that because he denied the allegations before publication, and The Atlantic printed his denial alongside the story anyway, the magazine knowingly published falsehoods. The Atlantic has called the lawsuit meritless and pledged to defend its journalists and its reporting.
This is not The Atlantic's first clash with the Trump administration. Senior editor Jeffrey Goldberg was added to a Signal chat where Defense Secretary Pete Hegseth shared classified military strike plans, which led to a major story and a second article publishing the full chat thread.
Donald Trump's own history with defamation litigation is also part of the picture. Trump frequently threatens such suits but has notably never sued anyone who accused him of sexual misconduct, a pattern that raises questions about when and why these cases actually get filed.
