A federal judge has ordered the immediate release of Kilmar Albrego Garcia from ICE custody after eight months of detention. Garcia was one of approximately 260 young men deported to El Salvador's notorious Secot prison on March 15th when Kristi Gnome defied a court order to keep the plane grounded. The Trump administration claimed all passengers were Venezuelan gang members of Tren de Aragua, but roughly 85% had no criminal records and no evidence was produced linking any of them to gang activity.
Garcia and others like hairdresser Andre Jose Romero Hernandez endured four months of torture, daily beatings, physical assault, and sexual assault at Secot prison before being returned to the United States. Upon his return, the Department of Justice immediately indicted Garcia on human trafficking charges stemming from a years-old traffic stop in Tennessee where he was driving a Chevy Suburban with several Hispanic males. Tennessee State Troopers had released everyone without charges at the time.
The indictment alleged drug smuggling, drug trafficking, human trafficking, and soliciting images from a minor, yet only charged him with human trafficking from the Tennessee incident. Garcia has filed a motion to dismiss based on selective prosecution and vindictive prosecution. He will reunite with his wife and special needs child after eight months of separation, though he remains subject to pretrial restrictions including an ankle monitor. Only six people from the El Salvador flight had prior felony convictions. The administration's pattern continues with Venezuelan boat strikes where 85-87 Venezuelan fishermen have been killed without credible evidence of drug smuggling or cartel involvement.
