Marco Rubio's legal justification for Trump's military operation in Venezuela represents a complete breakdown of how international law and executive authority actually work. The Secretary of State claims US military forces were simply providing protection for federal agents serving an arrest warrant on Nicholas Maduro and his wife. The problem is that arrest warrants have no validity outside US jurisdiction. Once you cross international borders, the legal mechanism becomes extradition, which requires treaties between nations. Venezuela has no such extradition treaty with the United States.
The gang of eight, the top intelligence and national security members from both the House and Senate, received zero notification about Trump's decision to bomb Venezuela and conduct a kidnapping operation against a sitting president and first lady. Under normal circumstances, the executive branch briefs these legislative leaders before major military actions. This time, nobody in Congress knew anything was happening. Marco Rubio's argument that military force was necessary to protect agents serving a warrant in Venezuela sets a precedent that would allow any president to deploy the military anywhere in the world under the same flimsy justification.
Whether Zimbabwe, Brazil, Canada, Mexico, or Ecuador, this logic would permit military operations in any sovereign nation simply by claiming federal agents needed protection while serving warrants that have no legal standing outside US borders. The entire Venezuela operation appears driven by Trump's personal dislike of Nicholas Maduro rather than any legitimate national security threat or legal framework.
