Stephen Miller appeared on television making false claims about federal immunity for ICE officers and misrepresenting 18 USC 111, the federal statute governing interference with law enforcement. The deputy White House chief of staff told ICE agents they have immunity from prosecution while performing their duties, but federal immunity provides zero protection against state charges. Minnesota shooter Jonathan Ross faces state prosecution by Hennepin County District Attorney Mary Moriarty, making Miller's federal immunity claims irrelevant.
Miller claimed anyone who obstructs ICE officers commits a felony under 18 USC 111, but the statute requires physical force. First Amendment protected activities include photographing officers, using profanity, making rude gestures, challenging authority, refusing to comply with commands, peaceful protest, and verbal confrontation. Taking photographs, videotaping operations, calling officers names, flipping them off, and arguing are all constitutionally protected speech. The law only criminalizes physical contact or forcible prevention of duties.
ICE agents across the country have been threatening protesters with arrest for protected speech, incorrectly citing 18 USC 111 against people exercising First Amendment rights. Grand juries in Los Angeles and Washington DC refused to indict protesters multiple times. The Department of Justice struggles to prosecute even clear cases. Miller, who attended neither law school nor passed the bar, has no authority to grant immunity as deputy chief of staff.
