The Conservative Majority Has Destroyed the Supreme Court

The Supreme Court issued a decision this week allowing Texas to use congressional maps that a lower court found to be racially discriminatory gerrymandering. The lower court made specific findings of fact that Texas violated the 13th and 14th amendments and the Voting Rights Act by eliminating minority coalition districts. The Supreme Court disregarded those findings despite lacking clear error, which courts are not permitted to do under standard appellate procedure.

This Texas gerrymandering case may signal how the Supreme Court will rule on the pending Section Two case that could eliminate the last meaningful protection in the Voting Rights Act.
