The Supreme Court issued a decision this week allowing Texas to use congressional maps that a lower court found to be racially discriminatory gerrymandering. The lower court made specific findings of fact that Texas violated the 13th and 14th amendments and the Voting Rights Act by eliminating minority coalition districts. The Supreme Court disregarded those findings despite lacking clear error, which courts are not permitted to do under standard appellate procedure.
This Texas gerrymandering case may signal how the Supreme Court will rule on the pending Section Two case that could eliminate the last meaningful protection in the Voting Rights Act. If Section Two is struck down, Southern states could redistrict in ways that silence black and brown voters, potentially flipping 18 to 20 House seats from Democrat to Republican and securing a congressional majority for decades.
The conservative majority has already gutted voting protections through Rucho, which removed judicial review of partisan gerrymandering, and Shelby County, which eliminated preclearance requirements. Now Section Two faces elimination, effectively legalizing racial discrimination in voting and redistricting.
John Roberts built a reputation as an institutionalist who protects the Supreme Court, yet his court has systematically dismantled the Voting Rights Act. The conservative justices ignore constitutional law, precedent, statutes, and appellate standards. SCOTUS credibility continues eroding as Brett Kavanaugh, Neil Gorsuch, and the majority demonstrate that legal constraints no longer apply to their decisions. The three liberal justices watch as colleagues violate foundational legal principles with no accountability.
