The federal government faces jurisdictional limits as Hennepin County District Attorney Mary Moriarty pursues a murder case against ICE agent Jonathan Ross for the fatal shooting of Renee Good. Despite DOJ and FBI attempts to control the investigation, Minnesota Attorney General Keith Ellison and Moriarty maintain authority to prosecute crimes committed within their jurisdiction. The burden of proof at the grand jury phase requires only probable cause, a significantly lower threshold than the beyond a reasonable doubt standard needed for criminal trial conviction. Video evidence, including cell phone footage from the incident, provides substantial material for probable cause determination.
Hennepin County has prior experience prosecuting law enforcement officers for murder, including the successful Derek Chauvin prosecution following George Floyd's death in May 2020. The grand jury pool and criminal trial jury will consist primarily of Hennepin County residents from a Democrat-leaning jurisdiction. Federal withholding of physical evidence may actually harm the defense, as jury instructions permit jurors to consider one side's intentional evidence suppression when rendering their verdict.
