The DOJ filed a motion claiming federal courts lack jurisdiction to enforce federal laws, specifically the Epstein Transparency Act. Pam Bondi and Todd Blanch are refusing to comply with the Epstein files release required by Congress and signed by Trump. Thomas Massie and Ro Khanna, who wrote the Epstein Transparency Act, filed a motion for independent oversight after document production stopped in December. The DOJ found millions of pages in the Southern District of New York but has made illegal redactions and refuses to name co-conspirators.

Hawk examines how Trump's administration spent months bogged down by the discharge petition before Mike Johnson's House recesses delayed the vote. After the Epstein Transparency Act passed almost unanimously, Trump signed it with no political alternative. Now the attorney general claims courts have no jurisdiction over federal law enforcement. The last three weeks saw Venezuela, Greenland, Iran threats, and ICE incidents while Epstein files disappeared from public attention.

If the documents contained anything exculpatory for Trump regarding Jeffrey Epstein criminal activity, the DOJ would have released them on the December deadline. Supreme Court Chief Justice John Roberts reportedly has regrets over decisions expanding presidential power, but Trump expects protection from disclosure. The motion argues federal judges cannot enforce the law requiring Epstein file transparency, an absurd position that challenges basic constitutional authority and congressional legislation.
