After 27 years as a licensed trial attorney, Hawk has witnessed countless examples of legal incompetence, from insurance defense attorneys asking motorcycle clients about gas pedals and airbags to questions about seatbelts on bikes. However, nothing compares to what happened in the Eastern District of Virginia with US Attorney Lindseay Halligan and the James Comey indictment.
Halligan, whose appointment was likely illegal, went into grand jury proceedings alone despite having zero criminal law experience and no prior grand jury experience. She failed to show the grand jury the actual indictment document, a catastrophic error that will likely result in the case being thrown out. The statute of limitations has already lapsed, meaning the prosecution cannot refile or fix the mistakes. Other assistant US attorneys in the Eastern District of Virginia refused to accompany Halligan because the case was fundamentally flawed from the start.
When attorneys from North Carolina were brought in to handle the trial, the judge asked about internal memos warning against prosecution. One attorney admitted he couldn't answer because Deputy Attorney General Todd Blanch instructed him to refuse. Halligan's appointment came from loyalty rather than qualifications or legal competence. Her inexperience as a prosecutor and complete lack of criminal law background led to courtroom failures that may result in disbarment for multiple attorneys involved. This prosecution represents an unprecedented level of legal malpractice at the federal level.
