A federal judge issued an emergency order prohibiting ICE agents from using pepper spray and pepper balls against peaceful protesters who aren't physically obstructing operations. The ruling addresses ICE agents routinely harassing, attacking, and arresting protesters engaged in constitutionally protected activities. The Department of Justice has begun incorporating arguments from Stephen Miller into federal court pleadings, including claims that federal judges lack jurisdiction over federal law enforcement officers and federal laws. These arguments appeared in filings related to the Epstein Transparency Act in New York.
ICE agents have been citing 18 USC 111 while arresting protesters for constitutionally protected speech and expression. Greg Bavino distributed legal refresher materials to ICE and CBP officers clarifying what the statute actually covers and what activities remain protected under the First Amendment. Despite the court order, ICE agents continue making arrests for protected activities in Minneapolis, where they've been operating with significant force.
Six federal prosecutors in Minneapolis resigned after Pam Bondi ordered them to stop investigating Jonathan Ross and the shooting of Renee Good, instead directing them to investigate Good and her wife for connections to Democratic organizations. The number two official in that US attorney's office was among those who quit. The mass resignation leaves the office understaffed just as ICE arrests create a surge of cases requiring prosecution. The Trump administration faces major obstacles securing indictments and convictions from Minneapolis juries after ICE occupied the city and arrested local protesters for constitutionally protected activities.
