Todd Blanch, Donald Trump's former personal criminal defense attorney who led his defense in the Manhattan trial resulting in 34 felony convictions, was named acting Attorney General after Pam Bondi was fired. On his first day, Blanch announced the DOJ will release no further Epstein files and will conduct no further Epstein investigations, even as multiple European countries continue actively pursuing those same files, with former Prince Andrew among those facing criminal charges.
Also on day one, Blanch commissioned an internal memo from the DOJ's Office of Legal Counsel concluding that the Presidential Records Act is unconstitutional. The Presidential Records Act, established after the Nixon presidency, has required all presidential administrations to preserve documents and records for over 50 years.
Hawk draws a direct parallel to the DOJ memos claiming a sitting president cannot be indicted, which are also not law but internal guidance that shaped how the Justice Department operates. This new memo, similarly, is not law but functions the same way, potentially allowing Trump to destroy records from his second term and take classified documents when he leaves office.
The classified documents issue connects directly to Jack Smith's 40-count federal indictment of Trump stemming from hundreds of classified materials found at Mar-a-Lago, including military attack plans Trump showed to guests at Bedminster. The use of Signal by Pete Hegseth to share classified war plans, which reached Atlantic editor Jeffrey Goldberg by mistake, and Jared Kushner's WhatsApp communications with Saudi Crown Prince Mohammed bin Salman, which preceded a two billion dollar investment from the Saudi sovereign wealth fund, all fall under the same Presidential Records Act now being targeted.
