The Pentagon has ordered active duty soldiers at Fort Bragg to prepare for possible deployment to Minnesota, joining two battalions of paratroopers from Alaska. Active duty military deployment on US soil violates the Posse Comitatus Act of 1878, which restricts federal troops from acting as domestic police unless authorized by Congress or the Constitution through the Insurrection Act. Military personnel are trained for warfare and combat, not civilian policing or deescalation with American citizens on residential streets.
The unrest in Minneapolis stems directly from federal immigration enforcement actions. Over 3,500 ICE agents currently operate in Minneapolis, outnumbering the 600 Minneapolis Police Department officers by a ratio of six to one. These federal agents have created the conditions Trump now claims require military intervention under the Insurrection Act. The last invocation occurred in 1992 under George HW Bush during the Los Angeles riots following the Rodney King verdict. Earlier uses involved enforcing school desegregation in the 1950s under Eisenhower and Kennedy.
Minnesota Governor Tim Walz has activated the National Guard but has not yet deployed them. The constitutional crisis centers on whether active duty soldiers will follow orders to use force against unarmed American civilians in Minneapolis. Fort Bragg troops and Alaska paratroopers face a fundamental question about following deployment orders that could require them to fire on citizens exercising constitutional rights. The federal government has manufactured the emergency it now claims justifies unprecedented military action against Americans.
