Hawk breaks down the Supreme Court oral arguments on birthright citizenship, with Donald Trump sitting in the public gallery in what looks like a transparent attempt to pressure the justices. Every lower court, with judges appointed by both Democrats and Republicans, has ruled against Trump's executive order targeting birthright citizenship. The 14th Amendment could not be clearer: born in the United States, you are a citizen. No interpretation required.
Hawk points out two reasons Trump wants to end birthright citizenship, including the $5 million EB-5 style citizenship he is already selling, making the whole thing feel less like policy and more like a shakedown. The solicitor general arguing for the government got stopped cold by Chief Justice Roberts mid-argument, a signal that did not go unnoticed.
The bigger concern is whether this Supreme Court, the same conservative majority that overturned Roe v. Wade after 50 years of precedent, eliminated the Chevron doctrine, ended affirmative action, and invented presidential immunity out of thin air, will simply manufacture a new reading of plain constitutional language. Clarence Thomas and Samuel Alito are expected to side with Trump regardless. The real question is where the remaining conservatives land. A 9-0 ruling upholding birthright citizenship is the obvious correct outcome. Whether obvious and correct still matter to this court is another question entirely.
