The Supreme Court recently issued a shadow docket decision that carved out exceptions to the Fourth Amendment and the Fourteenth Amendment for Hispanic and Latino people in America. This ruling allows law enforcement and ICE agents to stop, detain, and question individuals without probable cause based solely on racial profiling. Justice Brett Kavanaugh wrote a concurring opinion that contained factual errors, leading to these encounters being called Kavanaugh stops.
Hawk examines video footage from Metairie, Louisiana, showing ICE agents chasing a 22-year-old U.S. citizen to her home after she was walking back from the grocery store. The woman, born and raised in New Orleans, was targeted simply for appearing Hispanic. These types of stops are now happening in Chicago, Portland, Los Angeles, Washington DC, and New Orleans as masked ICE agents patrol in SUVs looking for people who appear Latino.
The Supreme Court decision affects 60 million Hispanic and Latino people in the United States, including 50 million U.S. citizens who have now lost constitutional protections against unreasonable search and seizure. The ruling came without oral arguments or full briefing. Justice Kagan or Justice Sotomayor wrote a scathing dissent. This shadow docket approach bypasses normal Supreme Court procedures, allowing the majority to strip away constitutional rights with minimal scrutiny.
The court also reinstated a Texas gerrymandering map that a lower court explicitly found to be an illegal racial gerrymander, further demonstrating the lawless approach of the current Supreme Court majority.
